Gibraltar's Finance Centre.This is an extract what it had to say
Gibraltar.
At the southern tip of the Iberian Peninsula, Gibraltar
has specialized in allowing such letterbox companies, called "trusts."
The structure of such trusts means there is no real owner of the
company. They are often used to add a layer of secrecy to letterbox
companies, Meinzer said, which is particularly good for money
laundering.
Meinzer cited insider information in calling it "the
dirty end of the spectrum" for bringing money back into financial
markets. The presence of many gambling casinos there also comes into
play.

Regulation
(EC) n. º 2371/2002 of the Council of 20 December 2002 on the
conservation and sustainable exploitation of fisheries resources under
the common fisheries policy's main objective is to ensure sustainable
exploitation of living
fisheries and aquaculture in the context of sustainable development,
taking into account a balanced economic, environmental and social. To
do this, you have some management tools such as setting the Total
Allowable Catch (TAC) of different fish species and their distribution
in national quotas between Member States.
In
particular Article 20 lays down the procedure to limit catches or
fishing effort and allocation of fishing opportunities among Member
States, allowing them the power to decide the allocation of fishing
opportunities allocated to them between vessels flying their flag. According
to that article, the total allowable catches and quotas allocated to
Spain each year of fish species subject to this management mechanism
will be set by the relevant regulations.
Regulation
(EC) 1224/2009 of the Council of November 20, 2009, by establishing a
Community control system for ensuring compliance with the rules of the
common fisheries policy, set out in Article 105 deductions to apply in those cases where the available quota is exceeded for a given species.
Law
3/2001, of 26 March, the state Marine Fisheries, states in Article 8
that the head of the Department may adopt measures regulating fishing
effort, being among the same time limiting the fishery. Furthermore,
Article 27 provides for the distribution option fishing opportunities,
based on catch volumes or fee, and entitles the holder to distribute
Department to improve the management and control of fishing activities.
The
distribution of fishing opportunities for species subject to TAC and
quota system required under this order has been made in accordance with
historical catch data for the period 2002-2011, of the disposal of the
General Secretariat of Fisheries. In
turn, these data have been modulated to take account of socio-economic
aspects of the fleets concerned in the fisheries and the dependence of
the different fleets for each species.
Proper
management of the quotas allocated to Spain in zone IXa International
Council for the Exploration of the Sea (ICES) and secure the fishing
fleet activity throughout the year, it is not necessary in this case for
a differentiated management each of the methods surveyed in the fishery of the Gulf of Cadiz.
On
the other hand, in the case of the anchovy fishery for siege mode, the
allocation of fishing opportunities and its management will be held
jointly in the field of associative entities belonging to the vessels of
that census. The allocation of the share of anchovy between associated entities will be made by order of the Secretary General of Fisheries.
Moreover
it is necessary to regulate the fishery for octopus in the fishery of
the Gulf of Cadiz taking specific measures to those vessels surveyed in
the arts category fishing under that species.
On the other hand, proper management of fisheries requires the adoption of technical measures. By
this order is intended to end the existing regulatory dispersion,
grouping the various technical measures affecting different fleet
segments operating in the fishery waters of the Gulf of Cadiz, all
within the framework of what set about Real Decree
632/1993, of 3 May, which regulates the practice of bottom trawling in
the Gulf of Cadiz, Royal Decree 1428/1997, of 15 September, which
regulates fishing Caladero
minor arts in the Gulf of Cadiz, and Royal Decree 429/2004, of March
12, for establishing management measures purse seine fishing fleet.
It
has made the process of communication to the European Commission under
Article 46 of Regulation (EC) No 850/1998 of the Council of 30 March
1998 for the conservation of fishery resources through technical
measures for the protection of juveniles of marine organisms.
In
the preparation of this order have been consulted in the Autonomous
Community of Andalusia, the Spanish Institute of Oceanography and
Fisheries.
By virtue of this, I have:
Article 1. Purpose and scope.
1. This
order is to establish a management plan for fisheries in the Gulf of
Cadiz in foreign waters and distribute fishing opportunities that are
assigned to Spain within ICES Division IXa.
Two. Shall apply to the Spanish flag vessels surveyed in the methods of hedge, bottom trawling and minor arts in the Gulf of Cadiz.
Article 2. Distribution of fishing opportunities in the fishery of the Gulf of Cadiz.
1. Fishing
opportunities for stocks of monkfish (Lophiidae), horse mackerel
(Trachurus spp), hake (Merluccius merluccius), megrim (Lepidorhombus
spp), blue whiting (Micromesistius poutassou), Norway lobster (Nephrops
norvegicus), anchovy (Engraulis encrasicolus) and mackerel (Scomber
scombrus) for the fishery of the Gulf of Cadiz is calculated annually
from Spanish fees in accordance with the percentages set out in Annex
IV.
Two. Each
year, at the beginning of the fishing year, the General Secretariat of
Fisheries shall by order published in the "Official Gazette" initial
shares allocated to Spain for the different species described in this
Article and, if necessary, the
percentage that the General Secretariat of Fisheries shall reserve the
same for exchange with other Member States and to cover any excess in
the consumption of the initial shares.
Three. A
January 1 of each year (except in the first year of operation is made
after the adoption of this order, in accordance with the transitional
provision only), Secretary General of Fisheries adopted by resolution
published in the "Official Gazette the State "anchovy quota distributing the quotas for each associative entity.
Article 3. Management of fishing opportunities.
1. Distribution of fishing opportunities globally. The
fishing opportunities allocated annually to the fishing grounds of the
Gulf of Cadiz under Article 2, are assigned globally to all ships
registered in the modalities of trawl, purse seine and minor arts of the
Gulf of Cadiz, dividing linearly calendar quarters.
Two. Distribution of fishing opportunities for associative entity. Notwithstanding
the preceding paragraph, the fishing opportunities for anchovy IX
(Engraulis encrasicolus ANE/093411) listed in Annex IV shall be
distributed annually by associated entities, dividing quarterly
linearly.
The apportionment of the associative entity managed by each is the sum of the vessels belonging to that entity. At
the beginning of each year shall be determined by resolution of the
General Secretariat of Fisheries published in the "Official Gazette"
fishing opportunities of each entity and the vessels covered by it, for
what will be considered entity changes management that vessel owners have made up to 31 December of the previous year.
By 2013 the percentage share for each port are:
Barbate: 43%.
Punta Umbria: 24%.
Isla Cristina: 18%.
Sanlucar de Barrameda: 15%.
Article 4. Monitoring and control of quotas.
1. Monitoring fees depending on whether or not the vessels are subject to the obligation to carry Shipboard Electronic Journal.
a) Vessels shall keep a Journal Electronic On Board. Consumption
shares covered by this order, for those vessels that are required to
complete this newspaper as provided in Article 15.3 of Regulation (EC)
1224/2009, of November 20, 2009, will be verified by the Directorate
General of Fisheries through electronic transmissions that they made
and based on information obtained through sales notes.
b) Vessels not required to complete the Electronic Journal On Board. For
those vessels that are not required to keep the Electronic Journal On
Board as provided in Article 15.3 of Regulation (EC) 1224/2009, of
November 20, 2009, the Directorate General of Fisheries will monitor
consumption quotas
on the basis of the entries in the logbook, in landing declarations and
sales notes in, in the case of vessels over 10 meters in length, and
only on the basis of the information provided in the notes of sale in the event that these possess a length of less than 10 meters.
Two. Control quotas managed globally.
a)
Where, in accordance with the activity data available to the Secretary
General of Fisheries from the entries in the logbook, landing
declarations and sales notes, in the case of transfers of Electronic On
Board Journal ,
verify that the consumption of the quarterly amount assigned to a
particular species, as provided in Article 2.1 has been reached or is
close to be reached, the Directorate General of Fisheries and
Aquaculture issue a resolution, to be published in the «Official Gazette», ordering the closure of the fishery for this fishery.
b) The annual fee will be distributed linearly calendar quarters. In
the event that a quarter is found that the share of a given species had
been exceeded, the excess thereof shall be deducted from the quota
allocated to the fleet operating in the fishery of the Gulf of Cadiz in
the next quarter . By
contrast, if the consumption is less than a quota allocated in this
period, the excess will increase fee for the following period the
quarterly.
c)
In the case that the quota was exceeded available for a given species
in the last quarter of the year, the deduction will be the same as
provided in Article 105 of Regulation (EC) 1224/2009 of the Council of November 20, 2009, and will become effective on the quota assigned to it in the first quarter of next year. If
the deduction of that species is not sufficient to cover the excess
shall be deducted fees for other species associated with the fishery and
are divided by type or census, until the entire excess.
Three. Control shares associative entity managed.
a) The quota allocated to each entity associative linearly distributed quarterly.
b)
If, under activity data available to the Secretary General of Fisheries
from the entries in the logbook, landing declarations and sales notes,
in the case of transfers of Electronic On Board Journal verify
that the consumption of the amount allocated to the various associated
entities in the Gulf of Cadiz fishing grounds, as provided in Article
3.2, is reached or is close to be reached, the Directorate General of
Fisheries and Aquaculture dictate resolution,
to be published in the "Official Gazette", ordering the closure of this
fishery to vessels belonging to the associative entity.
c)
In the event that a quarter is noted that the quota had been exceeded,
the excess thereof shall be deducted from the quota allocated to the
fleet belonging to the associative entity in the next quarter. By
contrast, if the consumption is less than a quota allocated in this
period, the excess will increase fee for the following period the
quarterly.
d)
When October 1 finding that the vessels licensed to fish in the waters
of a third country under an agreement concluded by the European Union
have not consumed their quota, the remaining quota will be distributed
to all vessels in the Gulf census siege of Cadiz, including those vessels licensed to fish in the waters of a third country.
e)
In the case that the quota was exceeded available in the last quarter
of the year to an associative entity, the deduction will be the same as
provided in Article 105 of Regulation (EC) 1224/2009 of the Council of November 20, 2009, and will become effective on the quota assigned to it in the first quarter of next year.
April. The
Directorate General of Fisheries and Aquaculture communicated to
Andalusia, to the functional areas of provincial delegations of the
Government of Cadiz and Huelva, the Andalusian Federation of Fisheries
Associations, to the Andalusian Federation of Fishermen, the National Federation of Fishermen and CEPESCA, monthly, consumption situation of the quotas referred to in this order.
May. In
any case, when the Electronic Journal Aboard a ship is inoperative,
will not be allowed to exercise fishing to remedy that situation.
Section 5. Temporal changes of modality.
1. The
Directorate General of Fisheries of the Secretariat General of
Fisheries, Ministry of Agriculture, Food and Environment, authorize
temporary changes in fishing mode with other modes.
Two. Applications
shall be addressed to the Director General of Fisheries of the
Secretariat General of Fisheries, Ministry of Agriculture, Food and
Environment and submitted at any of the places specified in Article 38.4
of Law 30/1992, of November 26, Legal
Regime of Public Administrations and the Common Administrative
Procedure, as well as electronically as established in Law 11/2007, of
22 June, on electronic access of citizens to public services and should
show at least the name and address of the owner of the ship's name, ship registration and Folio, and the fishing method requested.
Three. Mandatory preliminary report will be non-binding and Andalusia, which must be issued within seven days. If not issued on that date, shall be deemed favorable.
April. The
Director General of Fisheries authorized reasoned according to the
state of the resource or fishery regulation needs temporary changes to
fishing mode periods not exceeding three months, extendable other three
provided within the calendar year, by decision to be issued and notified to the parties on the terms provided in Article 59 of Law 30/1992, of November 26, within 20 days. After
two months from the date on which the application has been entered in
the register of the competent body for processing without having been
notified of the resolution expresses, one can understand dismissed.
May. The
resolution does not end recayere administratively, being able to appeal
in under Article 115 of Law 30/1992, of November 26, with the Secretary
General of Fisheries.
Article 6. Technical measures.
Technical
measures of modalities fence, bottom trawling and fishing Caladero
Octopus National Gulf of Cadiz are regulated in Annexes I, II and III of
this Order.
Article 7. Offences and Penalties.
The
breach of the provisions of this order shall be punished as provided in
Title V of Law 3/2001, of 26 March, the state Marine Fisheries, and
Article 105 of Regulation (EC) 1224/2009 the Council of November 20, 2009.
Repeal unique. Repeal legislation.
Following regulations are repealed:
Order of June 13, 1966 for regulating fishing for shrimp and plaice in the Maritime Provinces of Seville and Huelva.

Transitional provision only. First sharing quota.
In
2013, the percentage of fishing opportunities allocated to all fleets
surveyed in the Gulf of Cadiz fishing grounds referred to in Article 1
shall be calculated according to Article 27 of Law 3/2001, of March 26,
of Fishing State
Maritime, based on historical catches 2002-2011 period available to the
Secretary General of Fisheries conducted by the entire fleet of fishing
area. In
turn, this data will be modulated to take account of socio-economic
aspects of the fleets concerned in the fisheries and the dependence of
the different fleets for each species.
Final provision one. Title competence.
This
order is issued under Article 149.1.19 ª of the Constitution, which
grants the State the exclusive competence of Marine Fisheries.
Second final provision. Entry into force.
This order shall come into force on the day following its publication in the "Official Gazette".

ANNEX I
Plan purse seine fishing in the Gulf of Cadiz
1. Scope
1.1
This plan shall apply to Spanish vessels that exercise seine fishing in
the outer waters of the National Caladero Gulf of Cadiz, between the
mouth of the Guadiana and the meridian of Punta Moroccan (005 ° 36 'W).
1.2
are licensed to practice fishing with purse seine fishing area in the
Gulf of Cadiz National vessels being registered in the Register of
Fishing Vessels and shipping companies, also included in the census
Siege mode National Gulf fishing area of
Cádiz, are in possession of a fishing license and fishing ground for
this mode all without prejudice referred to in Article 5, and in the
Royal Decree 429/2004, of 12 March, establishing measures of management of purse seine fishing fleet.
Two. Definition of purse seine
Art
means collect a rectangular network, whose ends terminate in fists,
circling shoals of pelagic and closed at its bottom by means of a purse,
giving rise to sack the fish.
Three. Dimensions of gear and mesh
3.1
The length of purse seine fishing area in the Gulf of Cadiz may not
exceed 450 meters, excluding cuffs, each of which may not exceed 15
meters.
3.2 The height of the purse seine shall not exceed 80 meters.
Aperture 3.3 Minimum mesh purse seine gear is not less than 14 millimeters.
April. Authorised species
The species authorized for purse-seine catches are:
a) Needle (Belone belone).
b) Bluefish (Pomatomus saltator).
c) Little tunny (Euthynnus alletteratus).
d) Bream (Pagellus bogaraveo).
e) Bogue (Boops boops).
f) Bonito (Sarda sarda).
g) anchovy (Engraulis encrasicolus).
h) Pandora (Pagellus erythrinus).
i) Mackerel (Scomber spp.)
j) Corvina (Argyrosomus regius).
k) Dorada (Sparus aurata).
l) Herrera (Lithognathus mormyrus).
m) pomfret (Brama brama).
n) mackerel (Trachurus spp.).
ñ) Lisas (Mugilidae.).
o) seabass (Dicentrarchus labrax).
p) Melva (Auxis SPPI).
q) pajel (Diplodus vulgaris).

May. Baitboat
The
bait fishery may only be practiced as auxiliary tuna and, therefore,
only by vessels authorized to fish for tuna with rods and bait and be
subject to the following rules:
5.1 Catches made bait may only be used as bait.
5.2 The minimum mesh size shall not be less than 10 millimeters.
5.3 Vessels shall be equipped with tanks that conserve live bait. In
each operation dedicated to catching bait obtained the amount thereof
shall not in any case exceed the capacity of the tanks above.
5.4 Vessels shall not use more than one task dinghy fishing for artificial light in catching live bait or bait.
5.5
The bait fishing is exempt from the rules in this Plan regulate fishing
effort, as well as compliance with the minimum sizes on under
Regulation (EEC) n. º 850/98, the Council of March
30, 1998, for the conservation of fishery resources through technical
measures for the protection of juveniles of marine organisms can not
capture or take on board specific species than live bait.
June. Fishing effort
6.1 Fishing effort, measured in days fishing, will not exceed 180 days per year per vessel.
6.2
The exercise of fishing activity shall be a maximum of 5 days per week,
must cease that activity for at least 58 consecutive hours a week.

July. Catches and landings
Vessels

9. Minimum sizes of harvested species
As
provided in Article 19.2 a) of Regulation (EC) n. º 850/98, the Council
of March 30, 1998, in the case of sardine and anchovy or anchovy be
tolerated up to a limit of 10 % by weight of the total catch of each species retained on board with undersized established. Individuals included in the indicated percentage in any case have a size equal to or greater than 9 cm.
The
percentage of those species undersized shall be calculated as a
proportion of live weight of all marine organisms on board after sorting
or on landing. The percentage may be calculated on the basis of one or more representative samples. Not exceed the limit of 10% during the landing, transportation, storage, display or offering for sale.
However,
in accordance with the provisions of the regulations (EU) via
established for each year the fishing opportunities and associated
conditions for certain fish stocks and groups of fish stocks, applicable
in Community waters and, in the case of Community
vessels in waters where catch limitations are required, in the case of
horse mackerel (Trachurus spp.) being subject to a 5% by weight and
total count, with size between 12 and 14 cm. For the purposes of the control of this quantity, using the coefficient 1.2 to the weight of landings.
10. Monitoring and evaluation of the fishing plan
In
order to verify the results of the implementation of the Plan of
fishing, their results will be evaluated from appropriate evaluation and
monitoring campaigns by the General Secretariat of Fisheries and timely
scientific reports.
The
Secretariat General of Fisheries, Ministry of Agriculture, Food and
Environment, held regular meetings in the framework of the Working Group
of the Gulf of Cadiz with representatives of the Autonomous Community
of Andalusia, the Spanish Institute of Oceanography and Fisheries to
analyze evaluation reports and study, where appropriate, the possible adoption of new measures to ensure effective fishing plan.
ANNEX II
Plan bottom trawling
1. Scope
The
provisions of this Plan shall apply to Spanish vessels exercise fishing
trawl in offshore waters of Caladero National Gulf of Cadiz, between
the mouth of the Guadiana and the meridian of Punta Moroccan (005 ° 36
'W) .
Two. Minimum mesh size
The minimum mesh size of bottom trawl nets shall be equal to or greater than 55 millimeters.
Three. Fishing Effort
Following measures shall be taken fishing effort:
3.1 Fishing effort, measured in days fished, not exceed 200 days per year and 18 hours a day at sea.
3.2
The exercise of fishing activity shall be a maximum of 5 days per week,
must cease that activity for at least 56 consecutive hours a week.
3.3 trawl vessels shall only be permitted a landing per calendar day.
April. Duration of the Nephrops fishery
Nephrops
capture may be made only in the fishing periods expressly authorized by

May. Catches and landings

7.1
In order to verify the results of the implementation of the Plan of
fishing, their results will be evaluated from appropriate evaluation and
monitoring campaigns by the General Secretariat of Fisheries and timely
scientific reports. Such assessments include demersal resources under the bottom trawl fishery.
7.2
The Secretary General of Fisheries, Ministry of Agriculture, Food and
Environment, during the term of this Plan, will hold regular meetings in
the framework of the Working Group of the Gulf of Cadiz with
representatives of the autonomous community of Andalusia and the sector bottom
trawl fisheries of the Gulf of Cadiz coast, to analyze and study
evaluation reports, if any, possible further action to ensure the
effectiveness of the fishing plan.
ANNEX III
Plan Octopus fishing in the fishery of the Gulf of Cadiz
1. Purpose and Scope
This
Plan is to regulate fishing for octopus in the outer waters of Caladero
National Gulf of Cadiz, between the mouth of the Guadiana and the
meridian of Punta Moroccan (005 ° 36 'W), which is applicable to ships
Spanish to exercise fishing in that fishery.
Two. Released
The
vessels to be carried on fishing for octopus with minor arts should
have a transferable authorization granted by the General Secretariat of
Fisheries, which shall be complementary to the fishing license and to be
carried on board. This shall be granted or not depending on the state of resources.
Three. Limitations on fishing activities
The following are limitations to fish for octopus:
a)
temporarily prohibiting fishing with the following minor arts: jigging
or goat, pots and gannets, from June 1 to July 15, inclusive, of each

April. Rules gear shot trap under and their characteristics
a) The gear shot trap under (pots and alcatruces) may be made only towards the beach and no closer than 6 miles from the coast.
b)
The technical characteristics of trap gear shall comply with the
provisions of Royal Decree 1428/1997, of 15 September, which regulates
fishing in the fishery minor arts of the Gulf of Cadiz. It is forbidden to use alcatruces made of PVC or other plastic material.
May. Minimum size and ban recreational fishing for octopus
Vessels
are prohibited from Spanish catch, retain on board, tranship and to
land octopus (Octopus vulgaris) unit weighing less than one kilogram in
the National Caladero outer waters of the Gulf of Cadiz.
