How do the people feel in Gibraltar about how Spain continues to bully and nothing is done?

The people of Gibraltar have suffered so much bullying and anti Gibraltar campaigns from Spain for many years and it is their continuous defiance that has led us to believe we cannot allow the UN Security Council to give a seat to Spain!

Can you imagine what more Spain would do to Gibraltar? Spain already tries to leave Gibraltar out of EU directives! Spain has no respect for Gibraltar or its waters - even being a so called Ally in NATO! I dread to think what Spain would make up next - that we are all terrorists?

It is a very dangerous scenario to say the very least that Spain (or any other Country) can think that in our modern world a bigger country can bully another smaller country just because they cannot let go of a very old claim that has no merit on the smaller country!

Spain is behaving worse than anyone can even imagine - so much so that in the minds of all who live and/or work in Gibraltar - the Frontier is virtually closed psychologically due to the amount of harassment and intimidation!

It is not normal that Riot police are placed at the border to intimidate and search at will even after being searched by other Spanish Paramilitaries at the customs area!

Intimidation - fear - treated like terrorist - would you want a Leader of that country to sit on the UN Security Council? DO you not think that that Leader will use the UN against the tiny country? Spain is a country that has not left fascism behind but rather lets it to continue to intimidate anyone who stands in their way!

So we urge support to STOP Spain getting a seat! We need people worldwide to stop a bully going into a position that will be used by Spain for nothing but to impose further suffering to many!

Mariano “Killjoy” is doing a tour of the Caribbean to gain support for entry into the UN Security Council.

I will not tire of saying that spain is embarked on a campaign to stifle the economy of a British territory, committing acts of aggression, intimidation, coercion, a country with a bad habit of reneging on treaties, awash with corruption, totally unreliable, incapable of uttering one single truth, a paradigm of a totalitarian regime and a Rogue Nation, and a country that should never be given another platform to spread their peculiar understanding of democracy.

Once again the UK should make it absolutely clear to spain that entry into this body will be vetoed in perpetuity by the UK, until spain lifts all restrictions and hostilities against Gibraltar and stops wasting everybody’s time pursuing and causing havoc over an illegitimate sovereignty claim.

While Gibraltar Government go out of their way to ensure that they follow all recommendations by the EU - Spain has done noting! In fact the moment the EU Inspectors left we had the queues all over again!

EU Commission spokesman says recommendations are Not Binding!

The frontier has this week again been the centre of attraction for visiting politicians and civil servants from the EU Commission.

Yesterday morning a group of about 60 or 70 people representing the various groups from both sides of the frontier opposed to the Spanish Governments disproportionate frontier controls gathered peacefully in the area of the frontier to await the arrival of the EU Commission team of experts.

The group were displaying a number of placards, banners and posters, leaving little doubt regarding the feelings to the Spanish Authorities current frontier action.
But yesterday it was all about the EU Commission who were back in town!

The EU Commission team were expected at 0830, by then a welcoming group consisting of the Deputy Governor, Commissioner of Police, Head of Customs, Andrew Bonfante Head of Border and Coast Guard Agency and Michael Llamas the Governments Legal Advisor were waiting by the pedestrian entry gate. 

At about 08.45am the EU delegation arrived consisting of 9 members headed again by Henrik Nielsen, Deputy Head of Unit Borders and Visas at the EU Commission.
EU Commission Team Made Up From Various EU Agencies

The EU Commission team was made up from various departments in Brussels, represented in the delegation were members of (OLAF) The European Anti-fraud Office, Taxation, Home Affairs, Justice Department and EU Employment people.

The delegation quickly got down to work, and was shown all the new installations and various works carried out in line with the Commissions November recommendations, which had been completed well within the six month period stipulated by the Commission.
In Depth Comprehensive Gibraltar Presentation!

From the frontier the EU Commission team were conveyed to the Sunborn Conference Centre were an in-depth presentation was presented to the visitors by all local pertinent heads of departments and agencies. 

The presentation included footage of the disproportionate frontier checks by the Spanish authorities when the EU Commission are not in town, also plans, figures and even legal presentations by Government experts.

EU Commission Spokesman Speaks to Panorama

The Commission delegation also allocated a five-minute slot to some of the NGO groups present at the frontier. Mainly so group members could present their respective views on the situation as seen by them at the frontier.

Panorama was able to speak to the EU Commission Spokesman (press officer) accompanying the delegation ‘Miguel Puente Pattison’ who said the Commission in November last year allowed a period of 6 months to enable both sides to put in place the measures (recommendations) into effect. The visit today by the Commission he said. Is as a consequence of the 6 months period having expired and the Commission has come to see for themselves what works have been completed on both sides.

No Recommendations Completed on Spanish Side

When asked that on the Gibraltar side all the works had been carried out, what were the recommendations on the Spanish side? Because none were visible, he replied, that on the Spanish side, they were asked to improve the flow of traffic. Although adding, that nothing appears to have been done. He also said the Commission has correspondence from the them (Spanish Government) that these works will be completed during a period of time (unspecified) Adding, that the Commission had asked Spain that their frontier controls should be justified and not to create traffic or a bottleneck congestion, and also for the Spanish authorities to adopt a risk based profiling system.

Generally both sides he said were asked to improve the circulation and traffic fluidity.
The other aspect he mentioned was the issue of tobacco, the Commission asked both sides to improve cooperation with each other, exchange of information. On the Gibraltar side we (the Commission) asked for legislative changes to their tobacco control laws, and in this respect, he said, there is lots of news! 

Panorama asked Mr Pattison if Spain was going to be given more time to complete their side of the Commissions recommendations, he replied, that what the Commission was doing now was an evaluation and listening to both sides, on what has been done and what needs to be done. 

EU Visit Was Routine and Expected

The Commission he added will also ask questions. Although pointing out that since last September there have been constant exchanges and contacts between the Commission and both sides. But it is always preferable he said, to visit in situ and see for oneself how things have gone, and than have an interaction with both sides to discus and clear any issues, and also to talk about the future. 

Report Could Take up to Three Months

The Commissions visit he said was in fact routine one that was expected. The actual evaluation report of this visit Mr Pattison pointed out, could take two or three months, even after the summer; there is no definitive date, he said, for the subsequent report.
EU Spokesman: EU Commission Has No Legislative Powers

When asked, if the Commission had set a period of 6 months for the works to be completed and Spain had done nothing, what powers did the Commission have to ensure these recommendations are completed:

He replied ‘they are only recommendations, surprisingly adding, that the EU Commission do not have legislative powers, they are recommendations!
In terms of power, he added, this would come from the European Institution that would/could apply political pressure and each side could take their respective measures. (I suppose he meant legal action)

Importantly, he also added that as recommendations they were Not Binding, there could be No Sanctions (on Spain). 

The power comes from political pressure, but no sanctions!

I forgot to mention … Miguel Puente Pattison – The EU Commission Spokesman is the Spanish EU Commission representative … He is in fact Spanish…and for good measure lives in Madrid!

PRESS RELEASE FROM GIBRALTAR GOVERNMENT

Government calls for action after EU Commission visit

The Government welcomes the second visit by European Commission officials to the land frontier between Gibraltar and Spain. This visit follows on from the first inspection on 25 September 2013 and the report of 15

November and it is a consequence of the lengthy delays being experienced by pedestrians and vehicles crossing the border.


These delays have come about as a result of the unlawful and disproportionate checks being conducted by the Spanish authorities at their whim. The Commission inspectors were able to witness at first hand the way in which the Gibraltar Government has complied with the implementation of the recommendations made to Gibraltar. This has included infrastructural, administrative and proposed legislative changes.

The most visible of the first are the additional lanes to enter Gibraltar, the barriers on each lane for vehicles exiting Gibraltar and the construction of a car search facility that can be used for both incoming and outgoing traffic. The members of the inspection team were given a tour of the frontier area and were able to see the infrastructure for themselves. They were then given a number of briefings by Government officials including Michael Llamas, the Chief Legal Adviser, the Commissioner of Police Eddie Yome, the Collector of Customs John Rodriguez, the Head Statistician Claire Kelly and the Principal Secretary to the Deputy Chief Minister Caine Sanchez. The Chief Secretary to the Government Ernest Gomez was also in attendance.

A number of pressure groups and NGOs then met with the Commission inspectors in order to put across their point of view. Commenting on the visit, the Deputy Chief Minister Dr Joseph Garcia said: “The European Commission has come to look at the progress in the implementation of the recommendations that were made to Gibraltar and Spain on 15 November. The reality is that in Gibraltar they have found more than just progress and the inspectors have seen that we have completed the works required whilst Spain has not even started. It is to be expected that the Commission takes note of this. Our understanding is that they will go to the Spanish side of the frontier and then go back to Brussels where they will produce another report into what they have seen.

There are a number of measures that the Commission could take culminating in opening infraction proceedings against Spain. They could also deploy a permanent monitor to the border for a fixed period of time. We would very much welcome this. We have nothing to hide.

It was to be expected that there was no frontier queue while the Minister for Europe was in Gibraltar yesterday and that there was no queue while the Commission inspectors were in Gibraltar today. Once they have left the area, the Spanish frontier authorities will then continue with their flagrant violation of the right to freedom of movement of EU nationals
through an internal border of the European Union.


The Government will continue to send the Commission statistical data, photographs and other evidence of the unlawful and disproportionate controls being exercised by Spain at its frontier with Gibraltar. We will continue to take the issue to the EU in order to keep it alive.”

The Defenders of Gibraltar now has a fully established UK office.

This will enable sustained and professional lobbying to be conducted on a constant basis in the United Kingdom.

The UK office is subordinate to the Gibraltar based committee.
